This Privacy Policy and Collection Notice explains how Day & Hodgson collects, holds, uses and discloses personal information in connection with our real estate services in NSW.

It applies to people who interact with us as buyers, sellers, landlords, tenants, applicants, property owners, customers, suppliers, contractors and website visitors.

  1. What is personal information and sensitive information?
    Personal information is information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether true or not and whether recorded.Sensitive information includes items such as health information, biometric information, racial or ethnic origin, religious beliefs and criminal record. We only collect sensitive information when permitted by law and where reasonably necessary, and usually with your consent.

    • Buyer/seller information (property interests, inspection attendance, communications with us, feedback, offer history).
    • Landlord information (ownership and property details, payment details, insurance details where relevant).
    • Tenant and applicant information (application details, employment and income information, rental history, references and supporting documents).
    • Website and enquiry information (information you submit via forms; device/technical data such as IP address via cookies/analytics where used).
    • CCTV footage at our premises where CCTV is operating (if applicable).

    • Directly from you in person (including at open homes and inspections), by phone, email or online forms.
    • From referees, employers, previous agents/landlords and service providers you authorise (for example, tenancy checks).
    • From publicly available sources where lawful and relevant (for example, online sources).
  1. Why we collect, use and disclose personal information
    • To provide real estate services (sales, leasing, property management and related support).
    • To manage inspections and appointments and respond to enquiries.
    • To process rental applications and manage tenancies.
    • To communicate with buyers, sellers, landlords, tenants, trades and service providers.
    • To meet legal and regulatory obligations (including record keeping and dispute resolution).
    • To run and improve our business operations and systems and maintain security.
    • To send direct marketing (where permitted) and provide an opt‑out option.
  1. Our systems and service providersWe use third‑party platforms to help deliver our services and manage enquiries, inspections, marketing, sales and property management. Where reasonably necessary for our functions, we may disclose personal information to these providers.Examples of platforms we use include:
    • REX Software (CRM)
    • Inspection Manager (inspection and enquiry management)
    • Pricefinder (property data services)
    • Property Tree (property management platform)
    • Microsoft 365 / Outlook (email and business communications)
    • ChatGPT (approved AI tool for de‑identified drafting/brainstorming only)
  1. Direct marketing
    We may send you marketing about property opportunities or services you may be interested in. You can opt out at any time by using the unsubscribe link (if provided) or by contacting our Privacy Officer.
  1. AI tools (including ChatGPT)
    We may use approved AI tools to assist with administrative tasks such as drafting, summarising and brainstorming. We do not intentionally input personal information or sensitive information into publicly available AI tools. Staff must use de‑identified placeholders and review all outputs before use.
  1. Overseas disclosures
    Some service providers we use may store or process information outside Australia. Where practicable, likely locations may include the United States and other jurisdictions depending on provider infrastructure and support arrangements. We take reasonable steps to ensure overseas recipients handle personal information consistently with the Australian Privacy Principles.
  1. Access and correction
    You may request access to, or correction of, personal information we hold about you by contacting our Privacy Officer. We will respond within a reasonable time. We may need to verify your identity before processing your request.
  1. Complaints
    If you have a complaint about how we handle personal information, contact our Privacy Officer with details. We will investigate and respond within a reasonable time.
    If you are not satisfied with our response, you may complain to the Office of the Australian Information Commissioner (OAIC).
  1. Retention and security
    We take reasonable steps to protect personal information from misuse, interference, loss, unauthorised access, modification or disclosure.
    We keep personal information only for as long as needed for the purposes described in this policy, unless we are required to retain it by law. As a guide, open home attendance records are generally retained for 12 months unless a longer period applies.
  1. Open home and inspection collection notice (summary)
    When you sign in at an open home or inspection, we collect your name and contact details (and may collect basic buyer preferences) to verify attendance, manage safety, respond to your enquiry and provide updates about the property and similar properties (unless you opt out).
